Credit Application Additional Disclosures
For All Applicants
Everything that you have stated in this application is correct to the best of your knowledge.
You are of legal age to enter into a contract.
You authorize the dealer and any finance company, bank, or other financial institution to which the dealer submits your application (“Creditor” or “we” or “us” or “our”) to obtain your credit report and employment history in connection with this application, and to provide and/or obtain information about our credit experience with you.
You must have physical damage insurance covering loss or damage to the vehicle for the term of any financing. You have the option to select an insurance agent or broker of your choice, whether or not affiliated with the Creditor.
Your choice of insurance will not affect the credit approval process unless the insurance does not satisfy the finance requirements or the insurance company does not satisfy the reasonable standards of the Creditor.
You agree that we, our affiliates, agents and service providers may monitor and record telephone calls regarding your account to assure the quality of our service or for other reasons. You also expressly consent and agree to us, our affiliates, agents and service providers using written, electronic or verbal means to contact you. This consent includes, but is not limited to, contact by manual calling methods, prerecorded or artificial voice messages, text messages, emails and/or automatic telephone dialing systems. You agree that we, our affiliates, agents and service providers may do so using any e-mail address or any telephone number you provide, now or in the future, including a number for a cellular phone or other wireless device, regardless of whether you incur charges as a result.
Important information about procedures for applying for opening a new account. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. What this means to you: When you apply for or open an account, we will ask for your
name, address, date of birth and other information that will allow us to identify you.
If you receive and accept a financing offer, generally the dealer will be the initial creditor under the financing contract and the dealer's financing partner will assume the contract as assignee. In certain auto purchases through Arkansas and Ohio dealers, your financing
agreement may be directly with the financing partner.
For California Applicants
Married individuals may apply for separate accounts.
For Maine Applicants
If your credit application is approved and you finance the purchase of your motor vehicle through Creditor, you will be required to insure the vehicle against loss or damage. Creditor requires collision coverage and comprehensive coverage or fire and theft coverage. In addition, if this application is for a lease, Creditor will also require you to obtain liability insurance.
You have the option to select an agent or broker of your choice, whether or not affiliated with Creditor. Obtaining insurance from a particular agent or broker does not affect credit decisions by Creditor, unless the insurance product selected violates the terms of your contract for the purchase or lease of the motor vehicle.
For New Hampshire Applicants
You acknowledge receipt of a true and completely filled in copy of the credit application form at the time of signing. If you are applying for a balloon payment contract, you are entitled, if you ask, to receive a written estimate of the monthly payment amount for refinancing the balloon payment in accord with the creditor’s existing refinance programs. You would be entitled to receive the estimate before you enter into the balloon payment contract. A balloon payment contract is an installment sale contract with a final scheduled payment that is at least twice the amount of one of the earlier scheduled equal periodic installment payments.
For New York Applicants
A consumer report may be requested in connection with your application for credit. Upon your request, we will tell you whether or not the consumer report was requested and give you the name and address of the consumer reporting agency that furnished the report. If your application is granted, subsequent consumer reports may be obtained in connection with any update, extension or renewal of credit.
For Ohio Applicants
The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.
For Rhode Island
Applicants Credit reports may be obtained in connection with your application.
For Tennessee Applicants
You must maintain insurance as described in the contract. You may purchase this insurance from anyone you choose. For Vermont Applicants
You consent to Creditor obtaining a credit report for the purposes of evaluating this application and to obtain subsequent credit reports, in connection with this transaction, for the purpose of reviewing the account, taking collection action on the account, or for any other legitimate purpose associated with the account.
For Wisconsin Applicants
Wisconsin law provides that no provision of a marital property agreement, a unilateral statement under the marital property law, or a court decree, will adversely affect a Creditor’s interests unless the Creditor, prior to the time the credit is granted, is furnished with a copy of the agreement, statement or decree or has actual knowledge of the adverse provision when the debt to the Creditor is incurred. If you are making this application individually and not jointly with your spouse, you understand that Wisconsin law requires that your spouse be given notice of this credit obligation.
